Terms of Service

These Terms of Service ("Terms") govern your access to and use of Zana, a coaching platform operated by Zana LLC. By using Zana, you agree to these Terms. If you do not agree, please do not use the platform.

1. Who We Are

Zana is operated by Zana LLC, a Vermont limited liability company. Contact information is at the bottom of these Terms.

2. Your Account

2.1 Eligibility

You must be at least 18 years old to use Zana. By creating an account, you represent that you meet this age requirement.

2.2 Account accuracy

You agree to provide accurate, current, and complete information during registration, and to keep it updated.

2.3 Account security

You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. Notify us immediately at betike@me.com if you suspect unauthorized access.

2.4 One account per person

You may not share your account with another person or create multiple accounts to circumvent restrictions.

3. Wellness Platform Disclaimer

Zana is a wellness and coaching platform, not a medical service.

By using Zana, you acknowledge that you are engaging in wellness activities at your own risk and that Zana LLC is not liable for any injury, illness, or health condition that may result from using the platform.

4. Your Relationship with Coaches

If you are a client, your coaching relationship is with your coach and/or the coaching business you joined — not directly with Zana LLC. Zana provides the software platform; your coach is responsible for the quality and nature of the coaching they provide.

Zana does not guarantee any specific results from coaching. Outcomes depend on many factors outside of our control, including your own effort and adherence.

5. Subscriptions and Payment

5.1 Subscription fees

Access to Zana may require a subscription. The price, billing frequency, and renewal terms are shown at the time of purchase. By subscribing, you authorize recurring charges to your payment method.

5.2 Payment processing

Payments are processed by Stripe. Zana does not store your full payment card details. By providing payment information, you agree to Stripe's terms.

5.3 Auto-renewal

Subscriptions renew automatically at the end of each billing period unless you cancel beforehand. You can cancel anytime from your account settings. Cancellation takes effect at the end of your current billing period.

5.4 Refunds

Subscription fees are non-refundable except where required by law. If you believe you were charged in error, contact us within 30 days at betike@me.com.

5.5 Price changes

We may change subscription prices. If we raise the price of your subscription, we will notify you at least 30 days in advance. You may cancel before the new price takes effect.

7. Your Content

7.1 Ownership

You retain ownership of content you upload to Zana (meal photos, check-in notes, messages, forum posts, measurements, etc.).

7.2 License to Zana

By uploading content, you grant Zana a limited, non-exclusive, worldwide license to store, display, and process that content solely for the purpose of operating the platform and providing services to you and your coach. This license ends when you delete the content or your account.

7.3 Community content

Content you post in community forums is visible to other members of your tenant. Do not post anything you would not want other members to see.

7.4 Removal

We may remove content that violates these Terms or applicable law.

8. Zana Intellectual Property

The Zana platform — including its software, design, branding, logos, and content we create — is the property of Zana LLC and protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works without our written permission.

9. Third-Party Services

Zana integrates with services like Zoom, Cal.com, Stripe, Oura, and Google Gemini. Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services, and integration is provided "as is."

10. Termination

10.1 By you

You can delete your account anytime from account settings or by emailing betike@me.com. Deletion takes effect within 30 days, after which your data is permanently removed (except where we are required to retain it by law).

10.2 By Zana

We may suspend or terminate your account if you violate these Terms, fail to pay, or engage in conduct that harms Zana, other users, or third parties. Where feasible, we will notify you and give you a chance to correct the issue.

10.3 Effect of termination

Upon termination, your right to access the platform ends immediately. Provisions that by their nature should survive termination (including payment obligations, liability limits, and dispute resolution) will continue to apply.

11. Disclaimers

ZANA IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, whether express, implied, statutory, or otherwise, including without limitation any warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy.

We do not warrant that:

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZANA LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, arising from your use of the platform.

Our total liability for any claim arising out of or relating to these Terms or the platform is limited to the greater of (a) the fees you paid to Zana LLC in the 12 months preceding the claim, or (b) one hundred US dollars ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so these limits may not apply to you in full.

13. Indemnification

You agree to defend, indemnify, and hold Zana LLC harmless from any claims, damages, losses, and expenses (including reasonable attorney fees) arising from (a) your use of the platform, (b) your violation of these Terms, (c) your violation of any third-party right, or (d) content you upload.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Vermont, without regard to conflict of laws principles.

Any dispute arising out of or relating to these Terms or the platform will be resolved exclusively in the state or federal courts located in Vermont, and you consent to the jurisdiction of those courts.

Before filing a claim, you agree to contact us at betike@me.com and attempt to resolve the dispute informally for at least 30 days.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email and/or through the platform at least 30 days before the new terms take effect. If you continue using Zana after the changes take effect, you accept the new Terms.
